Closed Circuit Television (CCTV) refers to camera surveillance devices that are used to record information about people and their activities.
CCTV is operated by CHT in a number of its care homes to:
- Help ensure the safety and security of our residents, staff, contractors, visitors and property;
- Detect and deter criminal behaviour;
- Investigate and manage complaints, misconduct and challenging behaviour.
Any footage collected will be used solely for these purposes or as required or permitted by law.
Footage that sufficiently identifies individuals which is collected via CCTV is considered personal information and is therefore subject to the Privacy Act 2020 (the Privacy Act).
CCTV operates 24 hours a day, seven days a week, consistent with the nature of our operation.
Visual footage of events and people will be captured. CHT does not use any facial recognition software or other “intelligent surveillance” technology.
Fixed CCTV cameras are located throughout our care homes including in entrances, carparks and passageways and other common areas. Fixed cameras are not installed in personal areas including bathrooms. These cameras will be identifiable and CHT will have signs showing where they are installed and how you can access our privacy and CCTV policy.
Footage collected via CCTV will be kept securely for up to 90 days. Storage footage can only be accessed by authorised CHT managers and staff. The Privacy Officer will keep a list of authorised individuals for this purpose. Footage will only be retained for longer than 90 days if needed for evidential purposes and may be stored on the investigation file.
Covert surveillance devices may be used in exceptional circumstances; for example, where management has strong grounds to suspect that theft or misconduct is occurring. In this case, covert cameras may be specifically required to detect or prevent potential criminal behaviour or behaviour that may impact on the safety of our residents. Approval from the CEO is required before a covert surveillance camera may be installed. Consent will always be obtained from residents and / or their authorised EPOA before surveillance devices are used in residents’ rooms.
If any criminal behaviour is recorded via CCTV, the footage may be provided to the Police.
Surveillance by third parties
Surveillance, including video or audio recordings, by third parties on CHT properties without its knowledge or consent is not permitted. CHT does not allow recordings to be taken of CHT staff or residents without their knowledge or consent.
CHT may disconnect any recording device immediately and asked that it be removed. Residents and their families will be notified of this requirement in their agreement with CHT.
We maintain these requirements for compliance with our legal obligations, to ensure the dignity and privacy of our residents, and the privacy of our staff.
